Terms of Use

Effective Date: September 28, 2026

These Terms of Use (“Terms”) govern your access to and use of the website, assessments, surveys, content, and other online resources provided by SHELA Commercial Strategy LLC (“SHELA,” “we,” “our,” or “us”). By using this website, you agree to these Terms. If you do not agree, please do not use the website.

1. Purpose of This Website

This website provides information about SHELA, its commercial strategy services, perspectives, assessments, surveys, and opportunities to contact or schedule a conversation with us. The website is intended primarily for business professionals and organizations evaluating commercial strategy, growth, prioritization, or related business issues.

2. No Client Relationship Created by Website Use

Using this website, completing the High Command Assessment, submitting a survey, downloading content, subscribing to communications, or scheduling an introductory conversation does not by itself create a consulting, advisory, fiduciary, or other professional-client relationship with SHELA. Any paid consulting engagement will be governed by a separate written agreement that defines the applicable scope, fees, responsibilities, deliverables, and other terms.

3. Assessments, Surveys, and Informational Content

The High Command Assessment and other SHELA assessments, surveys, tools, frameworks, articles, examples, and educational materials are provided for informational and business-discussion purposes. Assessment results are routing and preparation tools. They are not automated diagnoses, professional certifications, guarantees, or substitutes for a full evaluation of your business circumstances.

4. No Legal, Tax, Accounting, Investment, or Other Regulated Professional Advice

Unless expressly stated in a separate written engagement, website content is not legal, tax, accounting, investment, medical, or other regulated professional advice. You should consult appropriately qualified professionals regarding matters requiring such advice.

5. No Guarantee of Results

Business outcomes depend on many factors outside SHELA's control. Examples, case studies, historical results, frameworks, observations, and discussions of potential business impact are provided to explain experience or methodology and do not guarantee that you or your organization will achieve the same or similar results.

6. Intellectual Property

Unless otherwise stated, the website and its original content, including text, frameworks, assessments, graphics, branding, methodologies, page designs, and other materials, are owned by or licensed to SHELA and are protected by applicable intellectual-property laws. You may view and use website content for your own internal, lawful business evaluation. You may not reproduce, distribute, publish, sell, sublicense, commercially exploit, remove ownership notices from, or create derivative commercial materials from SHELA content without prior written permission, except as permitted by law.

7. Acceptable Use

You agree not to use the website to interfere with its operation or security; attempt unauthorized access to systems or data; introduce malicious code; scrape, harvest, or systematically extract content or data in a manner that burdens the website or circumvents access controls; impersonate another person or organization; submit unlawful, misleading, infringing, or malicious material; or use the website in violation of applicable law.

8. Information You Submit

You are responsible for ensuring that information you submit is accurate to the best of your knowledge and that you have the authority to provide it. Please do not submit confidential, proprietary, regulated, or highly sensitive information unless SHELA has specifically requested it through an appropriate channel and you are authorized to disclose it. Our handling of personal information is described in our Privacy Notice.

9. Communications and Scheduling

If you request information, schedule a conversation, or otherwise contact SHELA, we may send communications reasonably related to that request or relationship. Marketing and educational communications are subject to applicable consent and unsubscribe controls. Scheduling a meeting does not obligate either party to enter into a paid engagement.

10. Third-Party Services and Links

The website may link to or use third-party services, including platforms used for forms, scheduling, video meetings, email, CRM, social media, or other business functions. Third-party services are governed by their own terms and privacy practices. SHELA is not responsible for the availability, security, content, or practices of third-party websites or services that we do not control.

11. Website Availability and Changes

We may modify, suspend, discontinue, or update any part of the website, its content, assessments, links, or features at any time. We do not guarantee that the website will always be available, uninterrupted, error-free, or free of harmful components, although we use reasonable measures intended to maintain and protect our systems.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. SHELA disclaims warranties not expressly stated in a separate written agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights that cannot lawfully be waived.

13. Limitation of Liability

To the fullest extent permitted by applicable law, SHELA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, or inability to use, this website or reliance on website content. Any liability relating to a paid consulting engagement will be governed by the separate written agreement for that engagement. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

14. Honest Reviews and Feedback

Nothing in these Terms is intended to restrict your ability to provide an honest review or lawful feedback about SHELA, its services, or your experience, or to exercise rights that cannot lawfully be restricted.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except where applicable law requires otherwise. Any dispute relating solely to website use that is not governed by a separate written agreement will be handled in a court of competent jurisdiction as permitted by applicable law.

16. Changes to These Terms

We may update these Terms as our website, services, technology, or legal obligations change. The effective date at the top of this page will identify the latest version. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
